Decisions of Westmoreland County judges

The following is a partial list of criminal cases handled by judges in the most recent term of Westmoreland County criminal court. Some of the cases involve first-time offenders being enrolled in the Accelerated Rehabilitative Disposition program. The ARD program does not require that they plead guilty, but does require that they be placed on probation for up to two years. If they satisfactorily complete the probation, they may then file a petition to have the case expunged. Unless otherwise noted, court costs are placed on the defendant.

Judge John E. Blahovec

• James R. Zundel, 63, of 630 Cherokee Lane, Ligonier, was sentenced to one to five years in jail for the charge of driving under the influence. He was ordered to attend an alcohol highway safety school and his license was suspended for 18 months. He was granted work release.

• Lisa Marie Burnette, 23, of 1147 Murtha Way, Latrobe, pleaded guilty to possession of a controlled substance and theft by unlawful taking. She was sentenced to 30 days to six months in jail. She was ordered to undergo a mental health evaluation and follow all recommended treatment.

• Adam Neil Czerpak, 18, of 417 Enrico, New Alexandria, charged with use/possession of drug paraphernalia, was accepted into the probation without verdict program for six months. He was ordered to undergo a drug and alcohol evaluation and follow all recommended treatment.

• Shakiel Trevor Solas, 19, of 1207 Penn Ave., Jeannette, charged with fleeing or attempting to elude officer, was accepted into the ARD program for one day.

• David Holtzman, 36, of 211 Lloyd Ave., Latrobe, pleaded guilty to simple assault. He was sentenced to intermediate punishment for two years, with six months of electronic monitoring. He was ordered to undergo a drug and alcohol evaluation and follow all recommended treatment.

• Brian Keith Grosser, 38, of 108 S. Depot St., Mt. Pleasant, pleaded guilty to receiving stolen property. He was sentenced to three to 23 months in jail.

• Ronald Charles Lehman, 25, of 200 Malone Road, Derry, pleaded guilty to possession of a controlled substance by person not registered and use/possession of drug paraphernalia. He was sentenced to 90 days to 12 months in jail. He was ordered to undergo a drug and alcohol evaluation and follow all recommended treatment.

• Justin Scott Steininger, 22, of 46 E. Pittsburgh St., Greensburg, pleaded guilty to robbery. He was sentenced to one to two years in jail. To a charge of criminal conspiracy, he pleaded guilty and was sentenced to probation for two years. Sentences are to run consecutively.

• Deono Terrell Hainesworth, 20, of 626 Sidney St., Greensburg, pleaded guilty to two counts of statutory sexual assault. He was sentenced to 11 12 to 23 12 months in jail. To charges of indecent assault person less than 16 years of age and criminal use of communication, he pleaded guilty and was sentenced to probation for four years. Sentences are to run consecutively.

• Glenn Givens, 48, of 526 Second St., Brownsville, pleaded guilty to theft. He was sentenced to probation for one year.

• James Edward Pees, 45, of 816 Prospect St., York, pleaded guilty to fleeing or attempting to elude officer and habitual offenders. He was sentenced to 90 days to 12 months in jail. He was ordered to complete inpatient treatment.

• Kenneth John Czrnecki, 34, of 1135 Windcrest Drive, Greensburg, pleaded guilty to simple assault. He was sentenced to probation for two years. He was ordered to undergo a drug and alcohol evaluation and follow all recommended treatment. He also was ordered to attend and complete anger-management classes.

• Bryan Whitlock, 48, of 1487 Darlington Road, Ligonier, pleaded guilty to driving under the influence. He was sentenced to 72 hours to six months in jail. He was ordered to attend an alcohol highway safety school and his license was suspended for 12 months.

• Russell H. Kegg, 46, of 118 Barnhart St., Johnstown, was sentenced to 72 hours to six months in jail for the charge of driving under the influence. He was ordered to attend an alcohol highway safety school and his license was suspended for 12 months.

• Jamie Howell, 39, of 1379 5th Ave., Arnold, pleaded guilty to delivery of a controlled substance, possession with intent to manufacture or deliver and possession of a controlled substance. He was sentenced to one year less one day to two years less two days in jail.

• Jeffrey Thomas Maier, 20, of 101 Val Jo Drive, West Leechburg, pleaded guilty to theft by deception. He was sentenced to probation for one year.

• Raymond Brad Elrick, 34, of 46 E. Pittsburgh St., Greensburg, pleaded guilty to possession of a controlled substance. He was sentenced to probation for two years. He was ordered to undergo a drug and alcohol evaluation and follow all recommended treatment.

• Alfred J. Hill, 54, of Superior Road, Blairsville, pleaded guilty to driving under the influence. He was sentenced to intermediate punishment for six months, with 60 days of electronic monitoring. He was ordered to attend an alcohol highway safety school and his license was suspended for 12 months. He was granted work release.

Judge Richard E. McCormick Jr.

• Joshua Popelas, 18, of 1120 State Road, Monessen, charged with criminal conspiracy, was accepted into the ARD program for two years. He was ordered to pay restitution in the amount of $3,613.

• Bryan D. Barnard, 24, of 4100 Sweetbriar Drive, Irwin, charged with possession of marijuana, use/possession of drug paraphernalia and criminal conspiracy, was accepted into the probation without verdict program for 30 days.

• John Albert Panucci, 22, of 103 Bellfield Court, Greensburg, charged possession of marijuana, use/possession of drug paraphernalia and criminal conspiracy, was • accepted into the probation without verdict program for 30 days.

• Ernesto Suarez, 25, of 401 W. Main St., Mt. Pleasant, pleaded guilty to simple assault. He was sentenced to probation for one year. He was ordered to complete domestic-abuse counseling classes.

• Robert James Glendening, 22, of 429 Shogan Drive, Greensburg, pleaded guilty to retail theft. He was sentenced to probation for one year. He was ordered to undergo a drug and alcohol evaluation and follow all recommended treatment.

• Gregory Lynn Klingensmith, 45, of 192 County Line Road, Acme, pleaded guilty to driving under the influence. He was sentenced to intermediate punishment for six months, with 60 days of electronic monitoring. He was ordered to attend an alcohol highway safety school and his license was suspended for 12 months. He was granted work release.

• Shawn Michael Davison, 22, of 208 Hood St., Hutchinson, pleaded guilty to theft by unlawful taking and receiving stolen property. He was sentenced to 60 days to 23 months in jail.

• Justin Arthur Halterman, 31, of 1127 Brookside Drive, Greensburg, pleaded guilty to driving under the influence. He was sentenced to intermediate punishment for five years, with 180 days of electronic monitoring. He was ordered to attend an alcohol highway safety school and his license was suspended for 18 months. He was granted work release.

• Jerome Zuzak, 22, of 106 Bowstring St., Greensburg, charged with use/possession of drug paraphernalia, was accepted into the probation without verdict program for one year. He was ordered to undergo a drug and alcohol evaluation and complete anger management classes.

• Frederick Allen Stormer, 23, of 211 Dogleg Lane, Latrobe, pleaded guilty to driving under the influence. He was sentenced to intermediate punishment for six months, with 30 days of electronic monitoring. He was ordered to attend an alcohol highway safety school and his license was suspended for 12 months. He was granted work release.

• Larry Jay Sorton, 55, of 901 Pine View Drive, Elizabeth, pleaded guilty to driving under the influence. He was sentenced to intermediate punishment for six months, with 60 days of electronic monitoring. He was ordered to attend an alcohol highway safety school and his license was suspended for 12 months. He was granted work release.

• Melissa L. Helms, 36, of 1369 Route 981, Smithton, pleaded guilty to driving under the influence. She was sentenced to intermediate punishment for five years, with 180 days of electronic monitoring. She was ordered to attend an alcohol highway safety school and her license was suspended for 12 months. She was granted work release upon verification.

• Melvin D. Grazetti Jr., 32, of 107 Jones St., Everson, pleaded guilty to driving under the influence. He was sentenced to probation for six months. He was ordered to attend an alcohol highway safety school.

• Terry Allen Burick, 39, of 851 Lloyd Ave., Latrobe, pleaded guilty to possession of marijuana and use/possession of drug paraphernalia. He was sentenced to probation for six months.

• Daryl Dee Dudley Jr., 24, of 444 Sidney St., Greensburg, pleaded guilty to simple assault. He was sentenced to three to 23 months in jail.

Judge Debra A. Pezze

Joseph Alxi Dulude, 21, of 4738 Route 66, Apollo, pleaded guilty to driving under the influence. He was sentenced to intermediate punishment for six months, with 28 days at an inpatient facility. He was ordered to attend an alcohol highway safety school and his license was suspended for 30 months.

• Bonnie Louise Cribbs, 43, of 11185 Route 85, Kittanning, pleaded guilty to possession of a controlled substance. She was sentenced to probation for one year. She was ordered to undergo a drug and alcohol evaluation and follow all recommended treatment.

• Terry James Roth, 21, of 203 Lilac Lane, Lower Burrell, pleaded guilty to aggravated assault, robbery and criminal conspiracy. He was sentenced to two to four years in jail. He was ordered to undergo a drug and alcohol evaluation and follow all recommended treatment.

• Keith Thomas McAlpine, 44, of 731 Moss Alley, New Kensington, pleaded guilty to driving under the influence. He was sentenced to 90 days to six months in jail. He was ordered to attend an alcohol highway safety school and his license was suspended for 12 months. To a charge of driving under a suspended license, he pleaded guilty and was sentenced to 90 days in jail. Sentences are to run consecutively.

• Tracie J. Hura, 35, of 252 Sandalwood Drive, Leechburg, charged with fraud obtaining food stamps/assistance, was accepted into the ARD program for two years.

• Shanna Rachelle Heymers, 28, of 2532 Virginia Drive, Lower Burrell, pleaded guilty to theft by unlawful taking. She was sentenced to probation for two years.

• Lynne Anne Fiedor, 38, of 1035 Greensburg Road, New Kensington, pleaded guilty to driving under the influence. She was sentenced to intermediate punishment for five years, with six months of electronic monitoring. She was ordered to attend an alcohol highway safety school and her license was suspended for 18 months. She was granted work release.

• James T. Miller, 19, of 798 Rubright Road, Apollo, pleaded guilty to theft from a motor vehicle. He was sentenced to probation for one year. He was ordered to undergo a drug and alcohol evaluation and follow all recommended treatment.

• Philip R. Griffin, 28, of 201 Depot St., Greensburg, pleaded guilty to possession of a controlled substance by person not registered. He was sentenced to four to 12 months in jail.

• George A. Beer Jr., 43, of 214 First St., Freeport, pleaded guilty to driving under the influence. He was sentenced to 48 hours to six months in jail. He was ordered to attend an alcohol highway safety school and his license was suspended for 12 months.

• Don C. Arner, 20, of 1252 Kenneth Ave., New Kensington, charged with use/possession of drug paraphernalia and possession of marijuana, was accepted into the probation without verdict program for six months.

• Justin Zaffuto, 20, of 1547 Dutch Run Road, Creekside, pleaded guilty to theft from a motor vehicle. He was sentenced to probation for one year and was ordered to undergo a drug and alcohol evaluation and follow all recommended treatment.

• Andrea D. Hughes, 38, of 1507 12 Leishman Ave., Arnold, pleaded guilty to criminal trespass. She was sentenced to intermediate punishment for one year, with 60 days of electronic monitoring.

Christopher Duane Hall, 25, of 206 Dorothy Ave., Leechburg, pleaded guilty to disorderly conduct. He was sentenced to probation for one year. He was ordered to perform 20 hours of community service.
