Decisions of Westmoreland County judges

The following is a partial list of criminal cases handled by judges in the most recent term of Westmoreland County criminal court. Some of the cases involve first-time offenders being enrolled in the Accelerated Rehabilitative Disposition program. The ARD program does not require defendants to make an admission of guilt, but does require that they be placed on probation for up to two years. If they satisfactorily complete the probation, they may then file a petition to have the case expunged. Unless otherwise noted, court costs are placed on the defendant.

• Corvette Byron Nichols, 44, of 1411 Fifth Ave., Arnold, pleaded guilty to possession with intent to manufacture or deliver. He was sentenced to three to 12 months in jail.

• Nikki Lee Bengel, 20, of 425 Oakland Ave., Greensburg, charged with theft by unlawful taking, theft by deception and receiving stolen property, was accepted into the ARD program for one year.

• Torey Williams, 24, of 711 Ninth St., Monessen, charged with possession of a controlled substance by person not registered, was accepted into the probation without verdict program for one year. She was also ordered to undergo a drug and alcohol evaluation and follow all recommended treatment.

• James John Thiem, 56, of 100 Bryn Mawr Court, Pittsburgh, charged with theft by unlawful taking, was accepted into the ARD program for one year. He was ordered to undergo an evaluation and follow all recommended treatment.

• Christopher James Bias, 28, of 427 Conrad Court, Derry Township, pleaded guilty to theft by deception, receiving stolen property and criminal conspiracy. He was sentenced to time served to 23 months in jail. He was also ordered to pay restitution in the amount of $12,600.

• Francis Gallo, 56, of 1527 Kenneth Ave., Arnold, charged with use/possession of drug paraphernalia, was accepted into the probation without verdict program for six months.

• John W. Marshall Jr., 24, of 4167 Evergreen Road, Pittsburgh, pleaded guilty to criminal conspiracy. He was sentenced to probation for one year.

• Jeffrey Scott Nedley, 25, of 270 McGeary Hollow Road, Allegheny Township, pleaded guilty to impersonating a public servant and false identification to law enforcement. He was sentenced to probation for one year.

• Matthew Ryan Kantoris, 23, of 1701 Dailey Ave., Latrobe, pleaded guilty to recklessly endangering another person. He was sentenced to 60 days to six months in jail.

• Terry E. Tiwold, 41, of 319 Woodhaven Drive, Monroeville, pleaded guilty to driving under the influence. He was sentenced to intermediate punishment for five years with 180 days of electronic monitoring. He was ordered to attend an alcohol highway safety school and his license was suspended for 18 months. He was also ordered to undergo a drug and alcohol evaluation and follow all recommended treatment. He was granted work release.

• Kelli Lyn Cole, 33, of 9860 Joan Drive, North Huntingdon, charged with false/fraud/incomplete insurance claim and false reports, was accepted into the ARD program for 12 months. She was also ordered to pay restitution in the amount of $1,552.75.

• Brian L. Visco, 28, of 2188 George St., North Huntingdon, pleaded guilty to driving under the influence. He was sentenced to intermediate punishment for six months with 60 days of electronic monitoring. He was ordered to attend an alcohol highway safety school and his license was suspended for 12 months. He was also ordered to undergo a drug and alcohol evaluation and follow all recommended treatment. He was granted work release.

• Shawn A. Pasternak, 35, of 230 Cresswood Drive, Elizabeth, pleaded guilty to driving under the influence. He was sentenced to intermediate punishment for five years with 180 days of electronic monitoring. He was ordered to attend an alcohol highway safety school and his license was suspended for 18 months. He was also ordered to undergo a drug and alcohol evaluation and follow all recommended treatment. He was granted work release. He was also ordered to pay restitution in the amount of $27,623.32.

• Christopher D. Gilroy, 20, of 403 Division St., Jeannette, pleaded guilty to verify address. He was sentenced to 30 days to 12 months in jail.

• Joann Loughner, 38, of 859 Greenhills Trailer Park, Hempfield, pleaded guilty to driving under the influence. She was sentenced to five days to six months in jail. She was ordered to attend an alcohol highway safety school and her license was suspended for 12 months.

• Ronald Todd, 60, of 606 Pennsylvania Blvd., Jeannette, pleaded guilty to driving under the influence. He was sentenced to probation for 12 months. He was ordered to attend an alcohol highway safety school and his license was suspended for 60 days.

• Brandi J. Ressler, 28, of 222 Jefferson Ave., Greensburg, charged with simple assault, recklessly endangering another person, criminal mischief and simple assault, was accepted into the ARD program for one year. She was also ordered to attend anger management classes.

• Solomon Kenneth Hickman, 38, of 515 Beulah Road, Pittsburgh, was sentenced to five to 16 years in jail for the charge of recklessly endangering another person. At a separate charge of robbery, he was sentenced to five to 16 years in jail. Sentences are to run concurrently.

• Greg A. Hayes, 44, of 1034 Price Ave., Columbia, S.C., was sentenced to probation for three years for the charge of possession of child pornography. He was ordered to attend sex offenders' classes and have no unsupervised contact with minor children. He was also ordered to have no Internet access and no computer unless for work purposes.

• Samantha Lynn Redfoot, 23, of 401 N. Ligonier St., Derry, pleaded guilty to retail theft. She was sentenced to probation for one year.

• James Marcinik, 40, of 210 Avenue C, Latrobe, charged with diversion of services, was accepted into the ARD program for 30 days.

• John Andrew Arnder, 21, of 240 Colleen Lane, Hempfield, pleaded guilty to use/possession of drug paraphernalia and retail theft. He was sentenced to probation for one year. He was also ordered to undergo a drug and alcohol evaluation and follow all recommended treatment.

• Twandrea Narie Brown, 20, of 836 Main St., Greensburg, pleaded guilty to possession with intent to manufacture or deliver. She was sentenced to probation for one year. She was also ordered to undergo a drug and alcohol evaluation and follow all recommended treatment.

• Matthew M. Medofer, 24, of 203 Cooperage Court, Mt. Pleasant Township, pleaded guilty to false identification to law enforcement officer. He was sentenced to probation for six months.

• Samuel K. Dean, 24, of 825 N. Main St., Greensburg, pleaded guilty to possession of marijuana and use/possession of drug paraphernalia. He was sentenced to 12 days to six months in jail, with credit for time served.

• James Ferrell Jr., 30, of 162 S. Pool Forge Road, Narvon, charged with theft of services, was accepted into the ARD program for six months.

Cheryl Lynn Nelson, 47, of 10924 Center Highway, North Huntingdon, pleaded guilty to driving under the influence. She was sentenced to intermediate punishment for five years with six months of electronic monitoring. She was ordered to attend an alcohol highway safety school and her license was suspended for 18 months. She was also granted work release.

• John R. Dougherty, 20, of 825 N. Main St., Greensburg, pleaded guilty to possession with intent to manufacture or deliver and possession of a controlled substance. He was sentenced to intermediate punishment for two years with six months of electronic monitoring.

• Kelly Pieri, 40, of 606 Sewickley Ave., Herminie, pleaded guilty to receiving stolen property. She was sentenced to probation for one year.

• Guy Rodgers, 36, of 1406 Taylor Ave., Arnold, pleaded guilty to simple assault. He was sentenced to three to 23 months in jail.

• Gregg Lane Snyder, 43, of 115 Bow String St., Greensburg, pleaded guilty to use/possession of drug paraphernalia. He was sentenced to probation for one year. At separate charges of possession of drug paraphernalia and driving under a suspended license, he also pleaded guilty and was sentenced to five days to 12 months in jail.

• Rahshan Anthony Allen, 22, of SCI-Camp Hill, Cumberland County, was sentenced to life without parole for the charges of murder of the first degree, murder of the third degree and firearms not to be carried without a license. He was also ordered to pay restitution in the amount of $2,106.

• Christopher Twigger, 22, of 13489 Route 30, North Huntingdon, pleaded guilty to false reports. He was sentenced to probation for one year.

• Mark Fetsko, 46, of 107 Ross Road, Ligonier Township, pleaded guilty to driving under the influence. He was sentenced to intermediate punishment for six months with 40 days of electronic monitoring. He was ordered to attend an alcohol highway safety school and his license was suspended for 12 months. He was granted work release.

• Oscar Reyna, 62, of 328 Weldon St., Latrobe, pleaded guilty to driving under the influence. He was sentenced to intermediate punishment for five years with four months of electronic monitoring. He was ordered to attend an alcohol highway safety school and his license was suspended for 18 months. He was granted work release.

• Justin J. Hayden, 27, of 564 Euclid Ave., Greensburg, pleaded guilty to aggravated assault, simple assault, harassment and criminal mischief. He was sentenced to intermediate punishment for two years with one year of electronic monitoring. He was also ordered to complete anger-management classes.

• Cody Alan Stivison, 22, of 206 Chestnut St., New Florence, pleaded guilty to driving under the influence. He was sentenced to 72 hours to six months in jail. He was ordered to attend an alcohol highway safety school and his license was suspended for 12 months.

• Charles Brandon Kunf, 28, of 1414 Main St., Latrobe, pleaded guilty to burglary, theft by unlawful taking and receiving stolen property. He was sentenced to nine to 23 month in jail.

• Michael J. Kochis Jr., 20, of 740 Robbins Station Road, North Huntingdon, pleaded guilty to disorderly conduct. He was sentenced to 18 days to 12 months in jail, with credit for time served. He was also ordered to undergo a drug and alcohol evaluation and follow all recommended treatment.

• Steven Dwayne Thurmond, 26, of 38 Potoka Drive, Tarrs, pleaded guilty to terroristic threats with intent to terrorize another, unlawful restraint, simple assault and harassment. He was sentenced to 19 days to 12 months in jail, with credit for time served. He was also ordered to undergo a drug and alcohol evaluation and follow all recommended treatment and attend anger management classes.

• Perry E. Knight, 41, of Greensburg RD2, pleaded guilty to fleeing or attempting to elude officer, recklessly endangering another person, and driving under a suspended license. He was sentenced to 18 to 48 months in jail.

• Eugene Victor Hunter Jr., 54, of 2202 School St., Mt. Pleasant, pleaded guilty to possession of a controlled substance and possession of firearms prohibited. He was sentenced to five days to 12 months in jail, with credit for time served.

• John J. Lewis Jr., 32, of 308 Washington St., Mt. Pleasant, pleaded guilty to theft by deception and receiving stolen property. He was sentenced to six to 23 months in jail. He was also ordered to undergo a drug and alcohol evaluation and follow all recommended treatment.

• Leroy Christopher Neal, 32, of 903 Washington St., Pittsburgh, pleaded guilty to sell noncontrolled substance. He was sentenced to six to 23 months in jail, with credit for time served.

• Derek James Smitley, 27, of Alverton, pleaded guilty to simple assault. He was sentenced to probation for one year.

• David Keith Sperry, 44, of 420 N. Fourth St., Jeannette, pleaded guilty to driving under the influence. He was sentenced to 72 hours to six months in jail. He was ordered to attend an alcohol highway safety school and his license was suspended for 12 months.

• Jerome A. Stout, 25, of 11 Cherry Ave., Mt. Pleasant, pleaded guilty to possession with intent to manufacture or deliver, possession of a controlled substance and use/possession of drug paraphernalia. He was sentenced to nine to 23 months in jail. He was also ordered to undergo a drug and alcohol evaluation and follow all recommended treatment.

• Brandon M. Smith, 27, of 5555 Jackson Ave., Export, pleaded guilty to driving under the influence. He was sentenced to 48 hours to six months in jail. He was ordered to attend an alcohol highway safety school and his license was suspended for 12 months.
