Fayette County woman settles lawsuit against state police

A Fayette County woman has apparently settled her federal lawsuit claiming that five state troopers from the barracks near Uniontown pepper-sprayed and urinated on her while she was shackled.

Derena Marie Madison, 41, of Smithfield claimed the incident occurred on Feb. 3, 2011, when state police arrested her for the summary offenses of public drunkenness and disorderly conduct. The officers denied urinating on Madison and contend that they pepper-sprayed her because she kept screaming and hurling racial epithets. After she calmed down, they used warm water to wash the spray out of her eyes, the officers say in court documents.

Both sides today filed a joint motion to dismiss the lawsuit. The motion doesn't provide any details of the settlement. Neither Madison's lawyer nore state police could be reached for comment.
