A federal judge on Thursday ruled that the Westmoreland County mother of a man who died from lung cancer waited too long to sue Armstrong County Jail officials on a claim of inadequate medical treatment.

Patricia Ann Granny of North Huntingdon sued the county and the state prison in Camp Hill. Douglas Rodger Granny, 47, died in July 2009 in the state prison at Graterford.

U.S. District Judge Joy Flowers Conti dropped the state from the lawsuit in August, ruling that it was immune to Granny's claim.

She ruled Thursday that the statute of limitations for claims against Armstrong County expired two years after Douglas Granny's last day in jail on March 22, 2009, so his mother was three months too late when she filed the lawsuit in July 2011.
