Moon supervisors voted on Wednesday to allow a controversial convenience store and gas station to be built.

Chairman Jim Vitale, vice chairman Andrew M. Gribben and John Hertzer voted to allow Enon, Ohio-based Speedway LLC to build a 3,900-square-foot store that would have six two-sided fuel pumps on Maple Street Extension in a Neighborhood Commercial District.

Joseph Wise and Marvin Eicher voted against it.

Convenience stores with gas stations are not permitted in that district, but Speedway had argued that its project would be a retail business with a gas station as an accessory use, as with a car repair business, which is a permitted conditional use.

Some residents had objected to Speedway's plan for several reasons, such as the potential nuisance of bright lights, traffic and crime.

Eicher contends that Speedway will bring more traffic to the area.

“I think that is contrary to the intent of the ordinance,” he said.

The supervisors said Speedway will have to meet certain conditions to operate, such as being open only between 4 a.m. and 11 p.m. and not receiving deliveries between 9 p.m. and 7 a.m.
