Jeannette convict arrested on child porn charges
A Jeannette man, who was convicted in 2005 of a sex crime, faces charges in Westmoreland County and Louisiana for allegedly uploading child pornography and sending sexually suggestive messages to a 13-year-old girl using a neighbor's Internet connection, police said.
Timothy L. Kelly, 38, of 311 S. 5th St., was charged Friday by Greensburg police Sgt. Robert Jones with dissemination of child pornography, possession of child pornography and related charges.
He is wanted by police in Louisiana on charges of computer-aided solicitation of a minor and indecent behavior with a juvenile.
The investigation began in November when Jones, a computer crimes investigator for the county, was contacted by the National Center for Missing & Exploited Children about 12 child pornography images that were uploaded to a Microsoft SkyDrive account.
Jones discovered the SkyDrive account, which is a computer storage account, was owned by Kelly, according to court papers.
Last week, Sgt. Chris Romero of the Calcasieu Parish Sheriff's Office in Louisiana contacted Jones about his investigation.
Romero told Jones he was investigating a suspect who used Facebook to communicate with a 13-year-old girl in his area. The suspect, whose Facebook account was listed as Timkothy Kelly, sent the girl about 1,400 messages via the social media website and nearly 200 text messages to her cell phone, according to court papers. Among the messages were several full-body nude photographs of the man, who asked the girl to perform sexual acts with him.
Romero found that the Internet address used to access the suspect's Facebook account was the same one used to access the SkyDrive account in Jones' child pornography case.
A computer at the Jeannette Public Library was used to log into the Facebook account.
Jones learned that Kelly lived next to the home where the Internet address was used.
Jones also discovered that Kelly had a prison record.
In December 2005, he pleaded guilty in Greene County to an incest charge and was sentenced to 15 to 36 months in prison.
Jones emailed Romero a photograph of Kelly, and Romero confirmed it matched the photographs and video sent to the girl.
On Monday, Jones obtained a fugitive warrant based on the charges filed against Kelly in Louisiana as well as a search warrant for Kelly's home.
Jones said when Kelly was questioned, he admitted using the SkyDrive account. When asked about the girl in Louisiana, Kelly replied, “I haven't talked to her for a long time,” according to court papers.
A forensic examination of a laptop and external hard drive at Kelly's home revealed four videos and one picture of girls around 7 to 10 years of age engaged in sexual acts, according to court documents.
Kelly was arrested Monday on the Louisiana warrant and was sent to the Westmoreland County Prison after failing to post $25,000 bond.
He was arraigned on Friday by Jeannette District Judge Joseph DeMarchis on the Westmoreland charges. DeMarchis set bail at $250,000. He faces a preliminary hearing Feb. 21.
