Decisions of Westmoreland judges

The following is a partial list of criminal cases handled by judges in the most recent term of Westmoreland County criminal court. Some of the cases involve first-time offenders being enrolled in the Accelerated Rehabilitative Disposition program. The ARD program does not require an admission of guilt, but participants are placed into the program for up to two years. If they satisfactorily complete the program, they may then file a petition to have the case expunged. Unless otherwise noted, court costs are placed on the defendant.

Judge John E. Blahovec

• Adam E. Barfield, 27, of 2901 NE 53rd St., Lighthouse Point, Fla., pleaded guilty to receiving stolen property and was sentenced to 45 days to 23 months in jail.

• Kevin Owen Kerlin, 21, of 780 Sunflower St., Irwin, pleaded guilty to retail theft. He was sentenced to probation for one year, was ordered to undergo a drug and alcohol evaluation and follow all recommended treatment.

• Joseph Michael Vantassell, 21, of 803A Canal St., Saltsburg, pleaded guilty to theft by unlawful taking and receiving stolen property. He was sentenced to nine to 23 months in jail.

• Brian Preston, 21, of 752 Seventh St., New Kensington, pleaded guilty to false identification to law enforcement officer and was sentenced to seven days to 12 months, with credit for time served.

• Kevin Lee Kerr, 20, of 422 N. Monroe, Titusville, charged with use/possession of drug paraphernalia, was accepted into the probation without verdict program for six months.

• Miles Austin Early, 20, of 950 Michelle Drive, New Kensington, charged with use/possession of drug paraphernalia, was accepted into the probation without verdict program for six months.

• Vernon James Klingensmith Jr., 20, of 149B Hamilton Ave., Vandergrift, pleaded guilty to use/possession of drug paraphernalia and was sentenced to probation for six months.

• Crystal Bonnoni, 20, of 1134 Terrace Ave., Vandergrift, pleaded guilty to retail theft and was sentenced to probation for one year. To a separate charge of conspiracy, she pleaded guilty and was sentenced to probation for one year. She was ordered to undergo a drug and alcohol evaluation and follow all recommended treatment. Sentences are to run concurrently.

• Matthew Mason Boxler, 30, of 817 Salt St., Saltsburg, pleaded guilty to theft by unlawful taking and receiving stolen property. He was sentenced to 12 days to 23 months in jail, with credit for time served.

• Bernard V. Lecce, 24, of 946 Academy Heights Drive, Hempfield, pleaded guilty to person not to possess/use firearm. He was sentenced to 10 to 23 months in jail. To a separate charge of terroristic threats with intent to terrorize another, he pleaded guilty and was sentenced to 10 to 23 months in jail. He was ordered not to possess any type of firearm. Sentences are to run concurrently.

• Breanna Marie Filapose, 24, of 946 Academy Heights Drive, Hempfield, pleaded guilty to driving under the influence and was sentenced to intermediate punishment for six months, with 40 days of electronic monitoring. She was ordered to attend an alcohol highway safety school and her license was suspended for 12 months. She was granted work release. To a separate charge of driving under the influence, she pleaded guilty and was sentenced to probation for six months. Sentences are to run concurrently.

• Frederick Thomas Leyland, 33, of 231 Silverview Drive, Sarver, pleaded guilty to driving under a suspended license and was sentenced to 90 days in jail.

• Brett A. Orris, 19, of 759 Jackson Road, Kiskiminetas Township, charged with use/possession of drug paraphernalia, was accepted into the probation without verdict program for six months.

• Ian M. Mackintosh, 25, of 105D W. Monroe St., Vandergrift, pleaded guilty to burglary, criminal trespass and criminal mischief. He was sentenced to 62 days to 23 months in jail, with credit for time served. He was ordered to attend anger management classes.

• Brian C. Russell, 51, of 448 North Ave., Kittanning, pleaded guilty to use/possession of drug paraphernalia and was sentenced to probation for one year.

• Kenneth John Spiering, 21, of 1032 Third Ave., Brackenridge, charged with use/possession of drug paraphernalia and possession of marijuana, was accepted into the probation without verdict program for six months.

• Jessica Moore, 19, of 119 Union Way, New Kensington, charged with simple assault, was accepted into the ARD program for six months.

• Dennis Albert Larkin, 30, of 146 Xavier Drive, Verona, charged with possession of a controlled substance, use/possession of drug paraphernalia and possession of marijuana, was accepted into the probation without verdict program for one year.

• Luke W. McHugh, 19, of 4046 Sinan Farm Drive, Murrysville, charged with use/possession of drug paraphernalia, was accepted into the probation without verdict program for one year.

Judge Alfred B. Bell

Brittany Noel Weir, 22, of 606 Division St., Jeannette, pleaded guilty to possession of a controlled substance and retail theft. She was sentenced to probation for one year and was ordered to complete drug treatment.

• Christina M. Antolik, 42, of 112 Fredonia Lane, Blairsville, charged with retail theft, was accepted into the ARD program for one year.

• Dale Allen Rose Jr., 23, of 10 Koter Drive, McCullough, pleaded guilty to possession of marijuana and use/possession of drug paraphernalia. He was sentenced to probation for one year, was ordered to undergo a drug and alcohol evaluation and follow all recommended treatment.

• Matthew Robert Stoken, 24, of 571 Brittany Court, North Huntingdon, pleaded guilty to driving under the influence and was sentenced to intermediate punishment for five years, with six months of electronic monitoring. He was ordered to attend an alcohol highway safety school and his license was suspended for 18 months. He was granted work release.

• Zachary Daniel Giovannagelo, 23, of 25 Miller St., Latrobe, pleaded guilty to use/possession of drug paraphernalia and was sentenced to five to 12 months in jail, with credit for time served. He was ordered to undergo a drug and alcohol evaluation and follow all recommended treatment.

• Kyle James Polechko, 20, of 428 Flagstaff Drive, Hempfield, was sentenced to probation for two years for the charge of manufacture, delivery, or possession with intent to manufacture or deliver. He was ordered to continue with drug treatment.

• Jodi Lynn Newhouse, 32, of 722 W. Second Ave., Derry, pleaded guilty to retail theft and was sentenced to probation for one year. She was ordered to undergo a drug and alcohol evaluation and follow all recommended treatment.

Judge Debra A. Pezze

• Kevin Henry Donegan, 50, of 4 Fawn Lane, Murrysville, pleaded guilty to recklessly endangering another person and was sentenced to probation for two years. To separate charges of recklessly endangering another person and criminal mischief, he was sentenced to probation for four years. He was ordered to pay restitution of $4,701 and was ordered not to possess or own any type of firearm during supervision. Sentences are to run consecutively.

• Candice Jackson, 22, of 616 Division St., Monessen, pleaded guilty to simple assault and aggravated assault by prisoner. She was sentenced to intensive probation for two years, with one year of electronic monitoring and was ordered to complete anger management.

• Alfred David Argiro, 25, of 917 Pittsburgh St., Scottdale, pleaded guilty to criminal conspiracy and manufacture, delivery, or possession with intent to manufacture or deliver and was sentenced to probation for one year.

• William R. Augustine, 35, of 165 Manns Road, Ruffsdale, pleaded guilty to simple assault and recklessly endangering another person. He was sentenced to intermediate punishment for two years with one year of electronic monitoring to be followed by probation for two years. He was ordered to undergo a drug and alcohol evaluation and successfully complete anger management classes.

• Paul Glen Foltz Jr., 54, of 209 N. Second St., West Newton, pleaded guilty to driving under the influence and was sentenced to 72 hours to six months in jail. He was ordered to attend an alcohol highway safety school and his license was suspended for 12 months.

• Ronnie Toth, 46, of 1229 Erickson Drive, Johnstown, pleaded guilty to retail theft and was sentenced to three to 23 months in jail.

• Myles Kenneth Liston, 35, of 323 Bedworth St., Pricedale, pleaded guilty to unauthorized use of motor/other vehicles and was sentenced to probation for two years. He was ordered to undergo a drug and alcohol evaluation and follow all recommended treatment.

• Lisa Thomas, 47, of 510 Three Mile Hill, Mt. Pleasant, pleaded guilty to retail theft, receiving stolen property and driving under a suspended license. She was sentenced to six to 23 months in jail, was ordered to be evaluated for the Day Reporting Program and follow all recommendations.

• David Keith Shoemaker, 25, of 408 S. Chestnut St., Scottdale, pleaded guilty to simple assault and was sentenced to probation for one year. He was ordered to undergo a drug and alcohol evaluation, follow all recommended treatment and complete anger management classes.

• Thorpe C. Diyanni, 46, of 155 Valley View Drive, Rostraver, charged with corruption of minors and recklessly endangering another person, was accepted into the ARD program for one year.

• Tiffany Gemas, 24, of 407 S. Broadway St., Scottdale, charged with robbery, receiving stolen property and retail theft, was accepted into the ARD program for two years.

• Summer Deanna Davis, 33, of 507 Pittsburgh St., Scottdale, pleaded guilty to retail theft and was sentenced to probation for one year. She was ordered to undergo a drug and alcohol evaluation and follow all recommended treatment.

• Leslee Ann Brown, 38, of 530 Rebecca St., Monessen, pleaded guilty to false reports and unsworn falsification to authorities. She was sentenced to probation for two years, was ordered to undergo a drug and alcohol evaluation and follow all recommended treatment.

• Duane Szymanski, 51, of 611 Oakland Ave., Charleroi, pleaded guilty to driving under the influence and was sentenced to 72 hours to six months in jail. He was ordered to attend an alcohol highway safety school and his license was suspended for 12 months.

• Tarra Marie Aquilina, 34, of 1204 Howard St., West Newton, pleaded guilty to retail theft and was sentenced to six to 23 months in jail.

• Marquise Adonijah Allen, 19, of 1528 Leishman Ave., Arnold, pleaded guilty to manufacture, delivery, or possession with intent to manufacture or deliver and possession of a controlled substance. He was sentenced to 18 to 36 months in jail. To a separate charge of driving under the influence, he pleaded guilty and was sentenced to 72 hours to six months in jail, was ordered to attend an alcohol highway safety school and his license was suspended for 12 months. To another charge of defiant trespass, he pleaded guilty and was sentenced to probation for one year. Sentences are to run concurrently.

• Bryan Keith Constable, 51, of 2411 Brownfield Drive, Hempfield, pleaded guilty to driving under the influence. He was sentenced to 72 hours to six months in jail. He was ordered to attend an alcohol highway safety school and his license was suspended for 12 months.

• Dwayne Wisnewski, 50, of 126 S. Quarry St., Mt. Pleasant, pleaded guilty to driving under the influence and was sentenced to intermediate punishment for five years, with six months of electronic monitoring. He was ordered to attend an alcohol highway safety school and his license was suspended for 18 months. He was granted work release.

• Robert Scott Hemminger, 29, of 1804 Raymond Ave., Latrobe, pleaded guilty to manufacture, delivery, or possession with intent to manufacture or deliver and possession of a controlled substance. He was sentenced to 15 to 30 months in jail. To separate charges of manufacture, delivery, or possession with intent to manufacture or deliver and possession of a controlled substance, he pleaded guilty and was sentenced to 15 to 30 months in jail. He was ordered to undergo a drug and alcohol evaluation and follow all recommended treatment. Sentences are to run concurrently.

• Andrew M. Parnell, 22, of 2216 Manordale Drive, Murrysville, charged with aggravated assault, simple assault, recklessly endangering another person and accidents involving death or personal injury, was accepted into the ARD program for 12 months.
