Allegheny County judge adds protections to moratorium on evictions

Allegheny County Commons Pleas President Judge Kim Berkeley Clark issued an order Friday protecting renters from eviction for the rest of the month.

The temporary order covers county residents not protected by Gov. Tom Wolf’s moratorium on evictions during the covid-19 pandemic.

The governor’s executive order does not impact evictions where the tenant has waived his or her right to receive a notice, according to information posted on the state’s Department of Banking and Securities website.

Wolf’s original order preventing evictions and foreclosures was set to expire July 10. The governor last month extended it through August.

Judge Clark’s order states “the commencement of new residential landlord tenant actions where the eviction is based solely on non-payment of rent or on a tenant holding over or exceeding the term of a lease shall be temporarily prohibited whether or not the lease includes a waiver of a ‘notice to quit’ provision.“

The order is in effect through Aug. 31. It does not affect cases previously filed.
