Allegheny County police do not plan to charge a jitney driver who fatally shot a passenger on Wednesday afternoon who was trying to rob him.

County police said a 73-year-old driver had picked up a 33-year-old man and another passenger in Duquesne.

While on the road, the passenger pulled a gun and struck the driver while demanding money from him, police said.

Police said the driver and the man got out of the car. The jitney driver pulled out his own gun and shot the assailant. The other passenger fled.

Police said they got the call for the shooting around 3:50 p.m. along Poplar Street. The wounded man was pronounced dead at the scene.

Detectives determined that the jitney driver legally owned the gun and he had a valid concealed carry permit for it.

The incident remains under investigation.

Anyone with information about the incident should contact Allegheny County police at 412-473-1387.
