A West Deer man who has been a registered sex offender since 2012 and was convicted in 2019 of indecent exposure and open lewdness in front of children, is accused of committing the same crimes again.

David Stanley Boyer, 72, of the 3000 block of Countrywood Drive was arrested and charged with six counts each of indecent exposure and open lewdness July 2 after a woman told police she saw him expose himself to five children who were outside playing Wiffle ball, according to his arrest papers.

Township police also charged Boyer with two counts each of indecent exposure and open lewdness July 20 in connection with a separate incident, according to court records.

Boyer was added to the state’s Megan’s Law list in November 2012 after being convicted of possession of child pornography, which is a federal offense.

Over the course of several days, police interviewed each of the children involved in the alleged Wiffle ball incident, who told them they were playing when one of them hit a home run that went into the high grass in Boyer’s yard, according to a criminal complaint.

One of the children told police they ran over to search for the ball and saw Boyer alone on his deck naked except for a shirt pulled up over his head. They told police Boyer was performing a sex act, the complaint said.

The four other children told police they could see what Boyer was doing from a distance.

Boyer is being detained in the Allegheny County Jail in Pittsburgh after his bail was denied. He was ordered to stand trial on the charges at the conclusion of a July 20 preliminary hearing before District Judge Tom Swan, according to court records.

Another incident

On the same day he was ordered to court, West Deer police filed two charges of indecent exposure and two charges of open lewdness against Boyer after a woman told police he exposed himself to her children while they were walking to school in early April.

The woman told police she first learned about the incident involving her two children after she came home and told them she had “good news” because the man they called “Creeper” had a court hearing that day and was in jail.

That prompted one of the kids to tell her that Boyer exposed himself and committed a sex act in front of them and a younger sibling.

The younger child said Boyer was inside his house in front of the window with his pants down.

Boyer faces a preliminary hearing on the charges before Swan on Sept. 14.

Court records show Boyer was convicted of one count each of open lewdness and indecent exposure in March 2019. He was sentenced to two years of probation.

The charges were filed in September 2018 by West Deer police, and Boyer was detained in the Allegheny County Jail on a $50,000 cash bond for eight days until the bond amount was reduced to nonmonetary, according to court records.
