Derry Township man pleads guilty in 2018 crash that injured motorcyclist
A Derry Township man pleaded guilty Monday to being under the influence of marijuana and causing a crash that severely injured a motorcyclist more than three years ago.
Orrin W. Burbank, 42, was charged last summer with aggravated assault with a vehicle and driving under the influence in connection with crash on state Route 217 in Derry on Oct. 3, 2018.
Police said Burbank was driving a Toyota Corolla about two miles from his home when he turned left and hit a motorcycle. The bike’s operator sustained substantial injuries in the cash.
According to court records, a blood test revealed Burbank had marijuana in his system. Investigators also said he did not have a valid driver’s license.
He was charged in 2019 but was not taken into custody until last June. Burbank has remained in jail since his arrest.
In court on Monday, Westmoreland County Common Pleas Court Judge Christopher Feliciani ordered Burbank to serve one year, less a day, to two years less a day, in prison and an additional five years on probation. The judge also ordered Burbank to pay nearly $8,400 in restitution to his victim.
Once released from jail, Burbank will be permitted to serve his probation in Virginia, where he is employed.
