Greensburg Rialto shooter denied shortened prison sentence
A Westmoreland County judge Thursday rejected a request to shorten the prison sentence of one of the two men convicted for their roles in a downtown Greensburg shootout in early 2022.
Evan Curley, 25, of Greensburg pleaded guilty to aggravate assault in connection with a confrontation in front of the former Rialto Bar & Bistro in which he and a bystander were wounded.
Curley and Stevin German, 28, formerly of Uniontown, were sentenced to 40 months to 10 years in prison for their roles in the shooting.
Curley asked that his minimum sentence be shortened by four months.
“He wants to complete his classes and be eligible for parole,” defense attorney Brent McCune said. “It’s a modest adjustment. We’re not asking for anything crazy.”
Curley and German were patrons at the Rialto on West Pittsburgh Street when a disagreement between the two men reached a tipping point, police said. Both left the bar, went to their vehicles to retrieve guns and returned to the Rialto, where they continued their dispute and exchanged gunfire on nearby Pennsylvania Avenue, according to investigators.
German fired eight shots, two of which hit Curley in the leg, police said. A bystander was shot one time in the buttocks.
Common Pleas Judge Christopher Feliciani said the sentence he imposed against Curley in November will stand.
“If you are doing everything Mr. McCune says you are doing in prison, I see no reason the parole board won’t release you after 40 months. I heard all of these arguments before and I am not hearing anything different today,” Feliciani said.
“I wouldn’t want to be in your situation but you put yourself there. You don’t seem like a bad person to me but you made a bad mistake that is going to cost you 40 months.”
