Police accuse Latrobe man of raping woman hours after prison release

A Latrobe man who completed a jail sentence for a drug-related conviction and parole violations Tuesday is accused of raping a Hempfield woman hours after his release.

Zackery D. Kimmick, 30, is back in the Westmoreland County Prison on $250,000 bond. He was arraigned Thursday on charges of rape, indecent sexual assault, indecent assault and simple assault.

A woman who lives about a mile from the county jail called state police to report she had been raped about 6:30 p.m. Tuesday by an unknown attacker, Trooper David Wineland reported.

She told police that the man, later identified as Kimmick, knocked on her door and asked to use her phone to call to a relative for a ride.

“Kimmick said he had just been released from jail and wanted to call his mom or dad for a ride. Kimmick said he knew the victim’s cousin and had stayed at her residence before,” Wineland said in court documents.

After she let Kimmick inside, he used her phone to make several telephone calls, Wineland reported. He then began making inappropriate comments to her and said he wanted to stay at her residence, the woman told police said.

Kimmick then forcibly undressed and raped her, Wineland reported.

According to Wineland, the woman had swollen lips from being punched and her shirt was ripped.

The woman said she did not know Kimmick but called her nephew, who helped identify his as the attacker.

At 11:50 p.m. Tuesday, Wineland said the woman identified Kimmick from a photograph lineup.

Police located and arrested Kimmick Thursday.

Court dockets confirm that Kimmick was released from the Hempfield jail after serving time for a drug-related conviction following his September 2019 arrest by Greensburg police.

According to records, Kimmick has a lengthy criminal record dating back to 2008 with multiple convictions for assault, indecent exposure and thefts.

In 2018, while serving time for exposing himself in Latrobe, Kimmick was charged by county detectives with exposing himself to nurses at the county jail. Court dockets indicate he pleaded guilty in that case and was sentenced to serve up to 23 months.

In 2016, Kimmick was ordered to serve up to 23 months after pleading guilty to resisting arrest and simple assault for choking a Mt. Pleasant policeman who was questioning him about a domestic assault from 2015.

Kimmick’s preliminary hearing on the rape charges is scheduled Nov. 20.
