Unity man accused of nearly hitting ambulance and spitting on, kicking state troopers
A Unity man remained in jail Monday after state police accused him of being high over the weekend when he nearly hit an ambulance in Derry Township and spit on and kicked two troopers, according to court papers.
Marshal Corb Wherry, 24, is charged with aggravated assault, resisting arrest, driving under the influence and related offenses.
Troopers were on patrol at 1 a.m. Saturday in the area of Latrobe Derry Road and Industrial Boulevard when they reported seeing a Toyota Camry at a red light in the wrong lane of Ash Street. The driver appeared to be “in a daze” and turned onto Industrial Boulevard, nearly hitting an oncoming ambulance, according to court papers.
Troopers initiated a traffic stop and Wherry nearly hit a parked car before stopping in the oncoming lane at the intersection of Depot and South Alexandria streets, police said. Wherry admitted to smoking marijuana, according to court papers.
During the ride to Excela Health Latrobe Hospital, police said Wherry was belligerent. He is accused of spitting in one trooper’s face and kicking the groin of a second when they got to the hospital, according to court papers. Wherry is being held in the Westmoreland County Prison on $50,000 bail.
He did not have an attorney listed in online court records. A Dec. 9 preliminary hearing is set.
Wherry is awaiting a Feb. 1 preliminary hearing on simple assault and harassment charges filed by state police in connection with an August incident in Unity, according to online court records.
He was sentenced in January 2018 to 18 months probation in Erie County court on resisting arrest and disorderly conduct charges.
