A Jeannette man narrowly escaped injury early Thursday after police said a neighbor shot at him.
Dale A. Shaw, 63, is accused of firing a handgun at his Chestnut Street neighbor at 12:30 a.m. after threatening the man and shining a spotlight at him, police reported in court papers. Shaw is being held in the Westmoreland County Prison without bail.
The neighbor declined to be interviewed but showed a 10-second video he recorded during the incident. The video shows him standing at his door and a man on the sidewalk holding something. The man recording ducks inside as a shot is heard.
An evidence marker was still visible on the door frame and the spotlight sat on the sidewalk later Thursday.
The neighbor told police he found that rocks had been thrown through his front window when he saw Shaw standing on the sidewalk shining a spotlight at the house. Shaw threatened to assault his neighbor and then fired the shot as the man was recording, police said.
Officers surrounded Shaw’s home after he refused to come out. He eventually did but then struggled with officers, one of whom used a Taser on him, according to court papers.
Police found a bullet lodged in the door frame and a 9mm shell casing on the sidewalk. An officer said they have been called to the street in the past for neighbor disputes between the men.
Shaw is charged with attempted homicide, unlawful possession of a firearm, aggravated assault and related offenses. He did not have an attorney listed in online court records. A Dec. 26 preliminary hearing is set.
Shaw lives in the same house where two of four teenagers were shot by his son, Cody Shaw, in March 2016 as they tried to break in through a window that held an air conditioner, police said. All four were charged.
Cody Shaw was never arrested. Residents can be protected by the state’s Castle Doctrine, a law that permits people to use deadly force when they fear for their lives or property.
