W.Va. judge dismisses lawsuit accusing teacher of sex abuse

WHEELING, W.Va. — A judge has dismissed a civil suit filed against a former teacher accused of sexually abusing a student for years and giving birth to his children.

The Intelligencer reports Ohio County Circuit Judge Jason Cuomo wrote in a ruling on Friday that he had to dismiss key elements of the lawsuit filed in April because the two-year statute of limitation had expired.

The now 28-year-old man filed suit in April against former Bridge Street Middle School science teacher and track coach, Elizabeth Harbert, in an effort to end their relationship but keep contact with his children.

The judge allowed one allegation that accused the Ohio County Board of Education of negligent retention, hiring and supervision to move forward.

A criminal case against Harbert is pending.
